Acceptance
You acknowledge receipt of these documents, which describe use of Services to Customer at the address or location where Services are installed, the terms and conditions of Services, and any devices including software required to provide Services that Locl.Net may provide to Customer (“Equipment”).
The Agreement defines Locl.Net’s obligations providing Services and Customer’s obligations using Services and Equipment.
Customer has accepted and shall be bound by all the terms and conditions set forth in this Agreement if Customer: 1) pays for Locl.Net Services; 2) provides Locl.Net with a written or electronic signature on a service order; 3) verbally orders Services from Locl.Net; and/or 4) activates and/or uses Services.
Installation and Access
Customers must provide access and prepare the site (e.g., relocation of furniture or equipment) for installation and maintenance. If a Customer is not the property owner, they must obtain access rights. If access is denied, the agreement may be voided. Installations are scheduled with the Customer. Additional charges may apply if more work is required than initially estimated.
Equipment Terms
All equipment remains the property of Locl.Net unless otherwise specified in writing. Equipment must be returned within 10 days of service termination or full replacement value will be charged to the Customer. Damaged equipment will result in additional fees. Tampering, relocation, or unauthorized modification of Locl.Net equipment is prohibited and may result in service disconnection, legal action, and recovery of damages.
Internet Service Use
Customers are responsible for all usage of their Locl.Net Services. Services may not be resold or shared without written approval. Use of the service for illegal activities is strictly prohibited.
Speeds are delivered on a best-effort basis and may vary due to network conditions.
Customers are responsible for securing their devices and networks. Locl.Net is not liable for unauthorized access, viruses, data breaches, or related damages.
All customers must comply with the Locl.Net Acceptable Use Policy (AUP). Violations may result in immediate suspension or termination of service.
Phone Service and 911 Limitations
Customers must register their physical address for 911 emergency service. If power or internet service is disrupted, or if the address is outdated, 911 dialing may fail. Customers are solely responsible for ensuring accurate and up-to-date registration.
Service Availability and Credits
Credits are issued for service outages longer than 72 consecutive hours caused by Locl.Net’s negligence, at a rate of 1/30th of the base monthly charge per qualifying 24-hour period. The Customer outage period begins when the Customer notifies Locl.Net of the outage. No credit is provided for outages caused by weather, force majeure, customer actions, or routine maintenance.
Default and Termination
Failure to pay amounts due for Services provided, failure to comply with service terms, or repeated delinquency may result in service suspension or termination. Early termination fees may apply. If terminated due to customer default, a termination fee of 50% of the remaining contract term, plus all outstanding and previously waived charges, will apply.
Limitation of Liability
Locl.Net is not liable for indirect, incidental, or consequential damages, including data loss, loss of profits, or unauthorized access. Services are provided “as is” without warranties beyond what is stated in this agreement.
Indemnification
Customer agrees to indemnify and hold harmless Locl.Net and its affiliates from any claims or liabilities arising from the Customer’s use of Services, violation of terms, or non-compliance with law.
Governing Law
This agreement is governed by the laws of the State of Indiana. Any disputes shall be handled in the courts of Indiana. Both parties waive any right to a jury trial.
Miscellaneous
The published Policies of Locl.Net, along with any Service Agreement, constitute the full and final agreement between Locl.Net and Customer. No assignment without prior written consent (except for corporate successor entities). Section headings are for reference only. If any provision is invalid, the remaining terms remain in effect. No third-party beneficiaries are created by this Policy or any Locl.Net Policy.
